Profile Poster Rights and Responsibilities

  1. Privacy
    1. Your privacy is very important to us. The Privacy Policy section of the Terms of Use discloses the site’s role regarding collection and usage of any content and information.

 

  1. Online Safety
    1. To help ensure the safe usage of the site, you commit to the following:
      1. You will not post unauthorized commercial communications (such as spam) on Justified Instructors.
      2. You will not collect users' content or information, or otherwise access Justified Instructors, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our prior permission.
      3. You will not upload viruses or other malicious code.
      4. You will not access or attempt to access an account belonging to another individual without expressed permission by said individual
      5. You will not bully, intimidate, or harass any user.
      6. Post inaccurate, defamatory obscene, shocking, hateful, threatening or otherwise inappropriate content or airing personal grievances or disputes
      7. You will not use Justified Instructors to do anything unlawful, misleading, malicious, or discriminatory.
      8. You will not do anything that could interfere with the proper appearance and functionality of Justified Instructors
      9. You will not facilitate or encourage any violations of this statement or our policies.

 

  1. Personal Safety and Injuries:
    1. Justified Instructors does not perform background checks on either instructors or potential customers who sign up to use the site. Justified Instructors encourages all users and instructors to take reasonable precautions to protect their safety and property while using the site and services. Users and Instructors are solely responsible for any and all injuries caused by their use of services. Users are encouraged to consult with a doctor before beginning any exercise program.

 

  1. Relationship of the Parties:
    1. Nothing contained in this Agreement or your use of the Site shall be construed to constitute either party as a partner, joint venturer, employee or agent of the other party, nor shall either party hold itself out as such.  Neither party has any right or authority to incur, assume or create, in writing or otherwise, any warranty, liability or other obligation of any kind, express or implied, in the name of or on behalf of the other party, it being intended by both parties that each shall remain independent contractors responsible for its own actions.

 

  1. Registration and Account Security
    1. Justified Instructors users provide their real names and information, and we need your help to keep it that way. Here are some commitments you make to us relating to registering and maintaining the security of your account:
      1. You will not provide any false personal information on Justified Instructors, or create an account for anyone other than yourself without permission.
      2. If we disable your account, you will not create another one without our permission.
      3. You will not use Justified Instructors if you are under 18.
      4. You will keep your contact information accurate and up-to-date.
      5. You will not share your password or let anyone else access your account, or do anything else that might jeopardize the security of your account.
      6. You will not transfer your account to anyone without first getting our written permission.

 

  1. Protecting the Rights of Others
    1. In order to maintain respect for the rights of others, you commit to the following:
      1. You will not post content or take any action on Justified Instructors that infringes or violates someone else's rights or otherwise violates the law.
      2. We can remove any content or information you post on Justified Instructors if we believe that it is in violation of any part of this written policy regarding content
      3. If we remove your content for infringing someone else's copyright, and you believe we removed it by mistake, we will provide you with an opportunity to appeal.
      4. If you repeatedly infringe other people's intellectual property rights, we will disable your account when appropriate.
      5. You will not use our copyrights or Trademarks or any confusingly similar marks, except as expressly permitted by Justified Instructors.
      6. You will not post anyone's identification documents or sensitive financial information on Justified Instructors.

 

  1. Payments
    1. Our policy regarding payments is outlined in sections 17, 18, and 19 of the Terms of Use.

 

  1. Amendments
    1. We’ll notify you before we make changes to these terms and give you the opportunity to review the revised terms before continuing to use our Services.
    2. Your continued use of the Justified Instructors Services, following notice of the changes to our terms, policies or guidelines, constitutes your acceptance of our amended terms, policies or guidelines.

 

  1. Termination
    1. If you violate the letter or spirit of this Statement, or otherwise create risk or possible legal exposure for us, we can stop providing all or part of Justified Instructors to you. We will notify you by email or at the next time you attempt to access your account. You may also delete your account or disable your application at any time.

 

  1. Arbitration
    1. Any dispute, controversy or claim arising out of or related in any way to this Agreement or any services performed hereunder which cannot be amicably resolved by the parties shall be solely and finally settled by arbitration administered by the (American Bar Association) in accordance with its commercial arbitration rules. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitration shall take place before a panel of three (3) arbitrators sitting in Pennsylvania (Philadelphia). The language of the arbitration shall be English. The arbitrators will be bound to adjudicate all disputes in accordance with the laws of the State of Pennsylvania. The decision of the arbitrators shall be in writing with written findings of fact and shall be final and binding on the parties. Each party shall bear its own costs relating to the arbitration proceedings irrespective of its outcome. This section provides the sole recourse for the settlement of any disputes arising out of, in connection with, or related to this Agreement.
